Welcome to Digital Builders. These Terms and Conditions govern your access to and use of the Digital Builders platform, including our website, mobile applications, and all associated services (collectively, the "Service"), operated by Digital Builders ("Company", "we", "us", or "our"). Digital Builders is the trading name under which Unity Space SLU, a company incorporated in Spain, markets and operates its products and services. By accessing or using our Service, you agree to be bound by these Terms.
"Platform" means the Digital Builders software-as-a-service community and learning management platform. "Community Owner" or "Administrator" means a user who creates and manages a community on the Platform. "Member" means a user who joins and participates in a community. "Content" means any text, images, video, audio, courses, materials, or other information posted or uploaded. "Subscription" means a paid plan granting access to specific Platform features. "AI Credits" means credits consumed when using AI-powered features.
You must be at least 16 years of age to use the Service. If you are under 18, you must have your parent or guardian's consent. You must provide accurate, complete, and current information when creating an account and keep this information updated. You are responsible for maintaining the confidentiality of your account credentials.
To access certain features of the Service, you must register for an account. You agree to provide accurate and truthful information, maintain and promptly update your account information, keep your password secure and confidential, notify us immediately of any unauthorised use of your account, and be responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.
Digital Builders offers multiple subscription tiers including Free, Basic, Advanced, Pro, and Enterprise plans. Paid subscriptions are billed in advance on a monthly or annual basis. Certain platform features consume AI Credits, including course generation, module creation, and lecture generation. Credits purchased as add-ons are non-refundable once consumed. Unused plan-included credits do not roll over between billing periods. Annual subscriptions may be eligible for a pro-rata refund within 14 days of purchase under EU consumer protection law. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
You agree not to use the Service to upload or transmit content that is illegal, harmful, or objectionable; infringe intellectual property rights; distribute spam or malicious code; engage in fraudulent conduct; attempt to gain unauthorised access to any part of the Service; scrape or use automated means to access the Service without prior written consent; violate any applicable laws or regulations; or impersonate any person or entity.
Community Owners bear additional responsibilities: establishing and enforcing community rules compliant with these Terms; moderating community content and member behaviour; ensuring content does not infringe third-party rights; complying with all applicable laws regarding member data; and maintaining accurate pricing and descriptions for paid content. Digital Builders is not responsible for the content of individual communities or the actions of Community Owners or Members.
The Service, including its design, software, and documentation, is owned by Digital Builders and is protected by intellectual property laws. You retain ownership of Content you upload to the Platform. By uploading Content, you grant Digital Builders a non-exclusive, worldwide, royalty-free licence to host, store, display, and transmit your Content as necessary to provide the Service. If you provide feedback or suggestions, you grant Digital Builders a perpetual, irrevocable, royalty-free licence to use such feedback.
The Service may integrate with third-party services including Zoom, Google Meet, Google Calendar, Stripe, and others. Your use of these integrations is subject to those third parties' own terms and conditions. Digital Builders is not responsible for the availability, security, or accuracy of third-party services.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Digital Builders does not warrant that the Service will be uninterrupted, error-free, or free of viruses. We do not guarantee the accuracy or completeness of any Content on the Platform.
To the maximum extent permitted by applicable law, Digital Builders shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. Our total aggregate liability for any claims shall not exceed the amount paid by you to Digital Builders in the twelve months preceding the claim. Nothing in these Terms limits liability that cannot be excluded under applicable EU or national law.
Either party may terminate these Terms at any time. Digital Builders may suspend or terminate your access to the Service immediately if you breach these Terms, engage in fraudulent activity, or if required by law. Upon termination, your right to use the Service ceases. Provisions of these Terms that by their nature should survive termination shall remain in effect.
These Terms are governed by the laws of the European Union and the national laws applicable in the jurisdiction where Digital Builders is registered. EU consumers also have the right to use the European Commission's Online Dispute Resolution platform.
